payments etc so it must be unique and altered.
1. PURCHASING OF ITEMS
A. Creating a Contract with Brays Furniture Ltd
A.1 You the customer place an order on the website by selecting an item and following the
instructions to the checkout process.
A.2 You will have the opportunity to check and correct any error in your order up until you
click the Submit Order button.
A.3 Once you have submitted your order you will receive an order confirmation e-mail
from Brays Furniture Limited. Please note that this e-mail is an acknowledgement and not
acceptance of your order.
A.4 If you are paying by credit card, we will authorize your debit or credit card payment
using our secure payment process via our World Pay payment system. If you are paying by
cheque, we will deposit your cheque on the first working day after we receive it. Please send
cheques to the company address on the website.
A.5 Once payment has been authorised, or your cheque has cleared, and we have determined
the availability of stock we will arrange for the delivery of the goods to you.
A.6 We reserve the right to decline all or part of any order for whatsoever reason and should
this arise? We will e-mail you with the details.
A.7 It is recommended that you retain all e-mails relating to your order and contract.
A.8 The details of your specific contract are filed by us. Should you want any information
regarding your order you may contact us. (For details see the contact us page of the Website
or Part D of these terms and conditions.)
B. Payment Process
B.1 If you have chosen to pay by card, once your order is received we will process the
payment for your order by way of the credit or debit card details you have provided. In the
event that there is insufficient stock to satisfy your order you will be informed as soon as
possible. A refund will be processed through your chosen credit or debit card used for the
payment of the order.
B.2 If you choose to pay by cheque, please send payment in full to the online showroom
address. Once your order is received we will deposit your cheque. Once the cheque has
been cleared for payment, we will begin processing your order. In the event that there is
insufficient stock to satisfy your order you will be informed as soon as possible. A refund
will be made by cheque from us to you should you decide to cancel your order before the
delivery has taken place.
B.3 If your order contains any item with a lead time of more than 4 weeks and you would
like to opt to pay a 50% deposit by card, the balance outstanding must be paid in full on the
same card before final delivery is made. If you wish to pay a deposit you must contact our
showroom and make a payment over the telephone. Please be aware we can only deliver
to the registered address of the card holder when paying by this method. A receipt for
the balance payment will be posted to your billing address. We do not operate a ‘cash on
delivery’ system.
B.4 We will advise you if your payment details cannot be authorized for any reason or if your
cheque has failed to clear. We may then invite you to pay by another method.
B.5 All prices and charges on this website are quoted in UK pounds. The price you pay
for your order is that price which is displayed on the website. Prices include VAT unless
otherwise stated but exclude delivery surcharges. Delivery surcharges are calculated based
on your location, please refer to our delivery policy for postcodes which carry a surcharge for
delivery. If we discover an error in the price of goods you have ordered we will inform you
as soon as possible and give you an option of reconfirming your order at the correct price, or
cancelling the order. If we are unable to contact you we will treat the order as cancelled and
you will receive a full refund.
C. Security of Payment Process
C.1 All credit and debit card payments that are made on our website are protected by a secure
connection. This secure connection ensures that your credit and debit card is encrypted prior
to it being transferred to the bank for authorization.
C.2 As an additional security means, no credit or debit card details submitted online are
stored directly by us once your order has been processed.
D. Delivery of Purchased Items to you
D.1 We will deliver the goods you have ordered to the address you give us for delivery at the
time you place your order. We can only deliver to addresses within mainland England and
Wales for our free delivery service. For the Scottish Mainland and other off shore locations,
additional charges will apply. Prices are available on application via e-mail. For the Channel
Islands, Isle of Man, Scottish Islands, Northern Ireland or the Republic of Ireland where we
are able to obtain quotations, again additional charges will apply. Customers in these areas
may prefer to appoint their own distributors / couriers.
D.2 We aim to deliver your furniture within the times quoted on our website when you
place your order. Where multiple items have been ordered, we will attempt to deliver them
all together by the longest lead-time quoted, unless a split delivery is requested and we are
able to meet your requirements. This additional service may be subject to a further carriage
charge. If the circumstances of your order change, we will contact you. If, however, it is
delayed due to circumstances beyond our control, then we cannot accept any liability for
consequential loss.
D.3 The delivery times quoted on the website are for delivery to postcodes which fall
within our normal delivery areas of 40 miles radius from a store. Should your postcode fall
outside our normal delivery area, delivery times may vary. We will inform you of this when
confirming acceptance of your order.
D.4 You will become the owner of the goods (and be liable for the loss or destruction of the
goods) at the time of delivery, provided that we have received payment in full for the goods.
D.5 Our Delivery Service team will carefully install your new furniture in your home,
exactly where you want it (subject to access). They will remove all wrappings and packaging
upon request and dispose of them for you. For customers with a 40 mile radius of a store or
distribution centre, for an additional charge, old furniture may be removed on a like for like
basis. Simply contact the showroom for this service when you place your order online and
you will be notified of the charge this service carries. We regret we are unable to offer this
service on large items of cabinet furniture being delivered via our supplier’s Direct Home
Delivery Services.
D.6 All deliveries are signed for. If you are out when our delivery team arrives, please be
aware that there may be an additional re-delivery charge.
E. Access to the destination room
E.1 Before placing an order, please check that the items of furniture will fit through any
passages, stairwells, landings and doorways on the way to their destination room.
E.2 Should you have any concerns over access, then please note them on the comments box
on the order or contact us by e-mail or on 0161 494 7555 for further assistance.
F. Cooling off Period (applicable to online orders only.)
F.1 You are entitled to a statutory cooling off period beginning from the date you place
your order online and ending 7 days after you received the goods. Certain goods are exempt
from this cooling off period, for example a mattress which has been taken out of its sealed
packaging in which it was delivered, and special order or bespoke items ordered.
F.2 You must inform us in writing during the cooling off period that you are cancelling the
contract (e-mails are accepted).
F.3 If you have not received the goods at the time of cancellation of the contract, and we have
not processed the goods for delivery, we will refund to you all the monies paid by you for the
goods in question including any delivery charges in the same form of payment originally used
for the purchase as soon as possible, and in any event within 30 days of the your cancellation
being accepted.
F.4 If you have not received the goods at the time of cancellation of the contract, but we have
processed the goods for delivery, and they are en route, you must not unpack the goods when
they are received by you. You are the owner of the goods once they have been delivered
to you and you are liable for their loss or destruction. The goods must be returned to us as
soon as possible. We will refund to you all the monies paid by you for the goods in question,
excluding the cost of collection of the goods, in the same form of payment originally used for
the purchase, as soon as possible and in any event within 30 days of your cancellation being
accepted.
F.5 If you have received the goods at the time of cancellation of the contract, the goods
must be returned to us as soon as possible. You are the owner of the goods once they have
been delivered to you and you are liable for their loss or destruction. The goods must be
returned to us as soon as possible. We will refund to you all the monies paid by you for the
unwanted goods in question, including any original delivery charge, and excluding the cost
of collection if that service has been rendered by us. The refund will be in the same form of
payment originally used for the purchase as soon as possible and in any event within 30 days
of your order being accepted, Provided that the goods are returned by you and received by
us in the condition that they were in when delivered to you. Please note when signing for the
delivery of your items you are accepting responsibility that they have been received in perfect
condition. Please inspect goods before the delivery driver leaves your premises. Documents
signed for as unchecked will be deemed as being received in good condition.
F.6 If you do not return the goods to us we shall be entitled to deduct the direct costs of
recovering the goods from the amount to be refunded to you.
G. Damaged Items
G.1 Every effort will be made to ensure that the goods you have ordered arrive undamaged
and without defect.
G.2 If the goods are found to be either damaged or defective in any way at the time of
delivery, you must not sign to say you have received them in good condition on the delivery
document provided by the home delivery team. If damage is discovered after delivery, you
must contact us on the day of delivery of the goods.
G.3 If the goods are damaged, and we are unable to repair the item to manufacturing
standards, we will send a replacement item upon confirmation that the damaged item has
been returned to us.
G.4 If the goods are found to be defective we will refund all monies paid by you for the
goods in question (including the delivery charges) together with any return delivery charges
you may have reasonably incurred if you have undertaken to return the items yourself, in the
same form of payment originally used for the purchase as soon as possible.
G.5 The amount of any refund under the guarantee shall be limited to the original purchase
price paid for the unsatisfactory merchandise.
Our guarantee does not extend to non-domestic usage, or to goods which are taken outside
the UK.
H. Cancellation by Brays Furniture Limited
H.1 We reserve the right not to accept any order request if:
H.2 We have insufficient stock to deliver the goods you have ordered;
H.3 We do not deliver to your area;
H.4 One or more of the goods ordered was incorrectly described or priced on the website;
H.5 The payment transaction is not authorized; or
H.6 You have not complied with the provisions of paragraph 12 of these terms and
conditions.
H.7 If we do cancel your contract we will notify you by e-mail and will refund to you any
sum paid by you to us in respect of the contract as soon as possible and in any event within
30 days of the cancellation of your order. We will not be obliged to offer any additional
compensation for disappointment suffered.
I. Stock
I.1 As far as reasonably possible all products featured to buy on the website are either in
stock and available at the time of ordering, or are produced to order with the anticipated lead-
time published on site

While every effort is made to meet our customers' demands, cancellations or variations may
be necessary as a result of an Act of God, war, strike, lockout, labour dispute, fire, flood,
drought, or other causes beyond our reasonable control.

Monday to Friday (excluding public holidays) only. Where items are shown as 'free shipping' on the site, the full cost of standard delivery to UK Mainland is included in the published price and quoted as free on our site.

D.8 For customer outside of a 40 miles radius in order to maintain our FREE UK Mainland delivery service, we operate a ONE man delivery service. This means that for large or heavy items, the recipient will need to organize some form of assistance at the point of delivery.Two man delivery service is available upon request - extra charge may apply.
D.9 Due to our insurance terms, drivers are not allowed to deliver items single-handedly up flights of stairs. However, if assistance is provided by the recipient, our logistic companies obliging drivers will often help to move items up flights of stairs, but please note that the items are not insured if damaged. It is illegal for our drivers to stop on a red-route. You must ensure that you have made alternative arrangements prior to their arrival.
D.10 All deliveries are signed for. If you are out when our delivery team arrives, please be aware that there may be an additional re-delivery charge. All recipients must inspect delivered item(s) and sign a delivery note to say that the item(s) are in 'as expected' condition. No refund claims can be made against us for item(s) that have been signed for.
D.11 Due to the nature of our insurance, we operate a door-to-door delivery service which means that items are delivered to the threshold of a property. Our friendly drivers will often assist in taking items beyond the threshold, but please note that they are not insured if any damage is caused, and therefore we cannot be held responsible.
D.12 Our large items such as garden furniture sets are delivered by pallet. Delivery of such items will be delivered as close to the proximity of the property as is physicaly possible. You will be contacted by the courier company to arrange a convinient time for you to receive your delivery. Should you live in an area which has difficult access points for large vehicles please advise us. If no advice is given and the delivery vehicle is unable to gain access via a single track road for example? You may incur further delivery charges.
